3. Purpose and Content of the Website

The Website presents Denona, its products, services, technologies, production capabilities, projects, references and other business-related information. The content of the Website is primarily for informational purposes, unless expressly stated otherwise in relation to specific content.

The publication of a product, service, technical capability, example of completed work, indicative price or other information does not, in itself, constitute a binding offer to enter into a contract. Where a price is displayed, it is indicated whether the price includes tax, delivery costs, handling fees and other charges that may affect the final price. The final terms of each transaction, including the price, completion period, technical specification, quantity, method of delivery and payment terms, shall be determined by a quotation, order confirmation, contract or other appropriate form of business correspondence between Denona and the customer.

4. Enquiries and Conclusion of Contracts

Submitting an enquiry or request for quotation through the Website only confirms that Denona has received the message. It does not mean that Denona has accepted an order or entered into a contract, unless the user has been expressly informed otherwise.

If the Website does not provide a specifically designated online contracting process, a contract is concluded only once the parties agree on the essential terms of the transaction in a quotation, order confirmation, contract or other business communication.

5. Rules of Use

Users must use the Website lawfully, responsibly and in accordance with its intended purpose. The following are prohibited:

  • compromising the security, stability, integrity or availability of the Website and associated systems;
  • attempting to gain unauthorised access to servers, databases, administrative interfaces or other protected parts of the system;
  • introducing, transmitting or distributing malicious code, viruses or other technically harmful content;
  • circumventing technical security measures or testing system vulnerabilities without Denona’s prior written authorisation;
  • automatically collecting content or data on a scale that exceeds normal use of the Website without Denona’s prior written authorisation;
  • using Website content in a manner that infringes the rights of Denona or third parties;
  • impersonating others or entering data which the user is not entitled to use;
  • using the Website in violation of applicable laws or accepted business practices.

Denona may restrict or deny access to any user who uses the Website contrary to these terms or in a manner that may compromise security, the rights of others or the operation of the Website.

6. Accuracy and Changes to Information

Denona endeavours to ensure that the information on the Website is accurate, complete and up to date. Due to changes in its offerings, technological developments and possible technical or administrative errors, certain information may temporarily be incomplete or outdated.

Photographs, visualisations, product images, samples, colours, dimensions, material descriptions and other visual or technical content may be provided for information purposes only. The appearance of colours and other properties may depend on the device, screen, settings and material. The final characteristics of a product or service shall be determined by the quotation, technical specification, contract or other document relating to the specific transaction.

Denona may change, supplement or remove content from the Website without prior notice.

7. Intellectual Property

The content of the Website, including texts, photographs, graphic designs, illustrations, videos, animations, logos, marks, names, technical drawings, databases, and the design and structure of the Website, is protected by copyright and other intellectual property laws.

Unless stated otherwise, the rights belong to Denona or to a third party that has authorised Denona to use the content. Publication of content on the Website does not constitute a transfer of rights or grant of a licence beyond what is necessary for normal browsing of the Website.

Without prior written authorisation, the content of the Website may not be reproduced, distributed, publicly disclosed, modified, adapted, sold or otherwise exploited commercially. Individual items of content may be downloaded or printed for personal, informational or internal business purposes, provided that rights notices are not removed and the rights of Denona or third parties are not infringed.

8. External Links and Third-Party Content

The Website may contain links or embedded content leading to third-party websites and services. Denona does not control such websites and is not responsible for their content, availability, security, privacy policies or business practices. The inclusion of a link does not mean that Denona endorses all content, products, services or opinions available on the external website.

9. Personal Data Protection

Denona processes personal data in accordance with applicable laws. Information on the categories of data, purposes and legal bases for processing, recipients, retention periods and data subjects’ rights is available in the Privacy Policy.

A user who provides Denona with the personal data of other individuals confirms that they have an appropriate legal basis for doing so and, where applicable, that they have provided those individuals with the necessary information about the processing.

10. Cookies

Information about cookies and similar technologies is available in the Cookie Policy. Strictly necessary cookies may be used without consent when required for the operation of the Website or to provide a feature requested by the user. Non-essential cookies are not activated until the user has made the appropriate choice, where consent is required under applicable laws.

11. Website Availability and Security

Denona takes reasonable technical and organisational measures to ensure the secure and reliable operation of the Website. Nevertheless, uninterrupted availability, complete freedom from errors or protection against all cyberattacks, malware and other circumstances beyond Denona’s reasonable control cannot be guaranteed.

Denona may temporarily restrict or suspend access to the entire Website or parts of it for maintenance, technical changes, security reasons or other justified reasons.

12. Limitation of Liability

Users should not make business, technical or other decisions solely on the basis of the general informational content of the Website where a specific quotation, technical specification or other confirmation from Denona is required for such a decision.

To the extent permitted by applicable laws, Denona shall not be liable for damage arising from technical disruptions, interruptions to internet connectivity, malfunctions of the user’s devices or software, acts of third parties or other circumstances beyond Denona’s reasonable control.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under mandatory provisions of law, including liability for intentional misconduct or gross negligence and other cases prescribed by law.

13. Amendments to the Terms

Denona may amend or supplement these General Terms of Use. The current version shall be published on the Website together with the date of the last update and shall apply from the date of publication, unless stated otherwise.

14. Severability

If any provision of these terms is found to be void, invalid or unenforceable, this shall not affect the remaining provisions. Such a provision shall be interpreted or replaced by a permissible provision that most closely reflects its commercial and legal purpose, within the limits of applicable laws.

15. Governing Law and Dispute Resolution

These terms and the use of the Website shall be governed by the laws of the Republic of Croatia. The parties shall endeavour to resolve any dispute amicably. If this is not possible, the court with jurisdiction shall be determined in accordance with applicable laws. This provision does not affect any rights granted to the user under mandatory provisions of law.

16. Language

If these terms are available in more than one language, the Croatian version shall prevail for the purposes of interpretation, unless mandatory provisions of law require otherwise.
